It's an interesting and moot point, who is actually paying that legal team. Are they happy with the value THEY are getting for their dollars?
Because like RAM says, it's not their interests directly that the legal team are looking out for.
It is also quite possible that the sentencing magistrate noted the supporters of other victims in the court, and their body language towards the perpetrator. Some magistrates are adept at reading the mood of their court.

Asking for an appeal gives EB the opportunity to get his affairs in order before serving a sentence. He obviously wasn't expecting more than a slap on the wrist. It may be standard practice on the legal teams part to appeal.

It also provides opportunities for the whole sordid affair to keep running and like someone said, for the press to get involved.
Just today the Anglicans are in the Vic news for badly managing CSA, and being sued for heaps.
If you wanted this to die away, would you want a much higher-profile appeal? It will likely get the appellant's name up in lights.
And what good can it do? Apart from maybe saving the individual sleeze from time in gaol, he's already been convicted and sentenced by a magistrate in a court of law. If he gets a lesser sentence on appeal, what is everyone who craves justice going to go away thinking? No winners here.

The legal team will have appealed against the sentence primarily because they feel the sentence is too high and that there is a great likelihood that the appeal court will reduce the sentence imposed. The lawyer will be acting on his client's behalf to get the best deal for him. It is something they have to calculate carefully because an appeal court can and sometimes does increase the sentence. Taking a chance simply to buy time for their client to get his affairs in order is an unlikely scenario. There's other ways that can be done. Also, appealing against sentence brings no guarantee that EB would have been released on bail. He could have been remanded in custody until the appeal hearing. In the eyes of the law EB could abscond to another country (knowing he faces a probable jail sentence) and it is unlikely any extradition warrant would be craved in view of the potentially light sentence. EB will be aware (hopefully) that prison culture will guarantee he will not be able to sit down properly for a long time after he completes his sentence.
Irrespective of the degree of his sentence, conviction is not in doubt. He is a convict awaiting sentence. Furthermore he is a worker convicted of serious CSA offences. In the eyes of professing innies and exes he is a sad, sad case. The real appeal that should and hopefully is taking place, is his appeal to God for mercy. He has done himself irrepairable damage for this life. That is something he shares with his victims.

Thanks for the clarification Ram. I agree whole heartedly with your last paragraph as well.

Thanks to all who posted here to inform those of us who knew nothing. Incidently EB used to write me from when we met few years ago. I always felt there was something strange about him but could never figure out what it was. He wrote not so long ago and said he wasn't active because of something from the past, but I had no idea what it was. I replied and wished him well, thinking it was a health problem. I don't want to have any more to do with him or anyone that can't see the wrong in CSA and such likes. I myself have suffered enough from folks who think they have authority to do what they like but are only bringing more shame to themselves which hurting innocent folks.

interesting Guest Visiting to have your perspective. We heard there are at least a dozen children victims of this perp and likely others too. Only one pressed charges. Some apparently more recent than others. The one he's being gaoled for might be from his past.
He has certainly left a trail of destruction of some beautiful young and innocent lives.

in reply #26, the poster "day in court " mentioned the liklihood of newspaper coverage at EB's County Court appearance to appeal his sentence for multiple CSA offences.
The problem of immorality in the ministry is a problem that the ministry leadership has failed dismally to deal with.
The 2 by 2's claim that they are the only true "way", but the performance of the leadership in the matters of current and ongoing sexual immorality, demonstrate that this church is not superior to the mainstream churches they stridently denigrate. It could be said that they are in fact inferior.
The leaders in Vic / Tas, and in other places as well, are proving themselves to be spiritually bankrupt and morally reprehensible.
It would be sadly ironic if it takes the unscrupuluous and uncaring secular media organisations to drag the fellowship into the light of open and honest disclosure so forcing the necessary changes to be made.
If the media did get involved, I imagine the leadership will adopt a siege mentality and demand the "faithful" close ranks behind them. The leadership will then be able to exercise even more abusive power and be more secretive.
If the friends accept or turn a blind eye to immorality in the ministry, immoral behaviours will ensue.
Until and unless the friends expect and demand moral behaviour from all the workers, nothing much will change.

Spot on cooee. The way this is being handled hints there's more to it. Possibly other guilty too, maybe even been a pedophile ring of them.
Think it through, the one whose been gaoled was companion of most of the current crop of workers over the 30 years he's been molesting children. Not one of them knew or even suspected him of being a pedophile? I don't buy that.
Turns out many of the friends knew he was creepy. But not one of his companions? Or were they too scared to take a stand? Or into it too? I smell a rat.

Being subservient to the system rather than Christ could go a l-o-n-g way towards keeping things in house. However, despite there being a large amount of truth in that, I don't expect to make many sales.

tassie tiger,
There is heaps more to it as you suspect, but just to clarify, the paedophile is currently not in prison. He has been sentenced to 6 months gaol, but has appealed the sentence and is currently out on bail.
This creeps criminal behaviour and serial child sexual abuse of little girls was know by several of the senior ministers. It is entirely possible that the reason they did nothing about it is because they themselves are morally compromised. There is a very strong stench of immorality about quite a number.

Interesting ---- I have not been keeping up with this but I find that fact of complicity of workers somewhat revealing. If I recall two of the workers who were convicted of similar in Michigan were at one time companions. Is this the new meaning of two by two?

I understand the legal stance on this case how ever a client still has the right to direct their lawyers, the lawyer acts on behalf of thier client. EB could have directed his lawyer that he did not wish to appeal and would accept a sentence and accept the sentence imposed by the magistrate. No emotion does not cloud the law how ever EB missed his opportunity to demonstrate his remorse in a public forum.

No emotion does not cloud the law how ever EB missed his opportunity to demonstrate his remorse in a public forum. EB has certainly NOT "missed" his opportunity to demonstrate his remorse in a public forum. I understand he is currently at liberty ? In fact I would argue that this circumstance affords him much greater opportunities to demonstrate his remorse. Amongst a wide variety of measures, the example of Judas comes to mind ! Yes you are right. A lawyer acts on his or her client's behalf and is subject to their directions, but in reality lawyers are hired for guidance in legal matters. In EB's shoes I doubt very much any one of us would pursue the line you suggest. Who knows what will happen with all this. God is in overall control. Time will tell. If EB has to serve a term of imprisonment it is best that he avoids communal showering, even if placed in the supposed security of a sex offenders' wing. A bar of soap thrown down deliberately at his feet would be a dreadful initiation to his period of gaol. Maybe his liberty at this time is HIS opportunity to show proper remorse before it comes to such things. There is Biblical precedent for using such opportunities wisely.

So what did this guy do? I ask because a 6 six month sentence is nothing! You can do a year for a misdemeanor if you make a judge mad, and for 6 months to be the max sentence available? He probably smacked some kid on the rear after he wouldn't stop begging for it... Smacking on the rear end is considered sexual assault now days... But a few more pages of this thread and will be the crime of the century without anyone saying what he actually did..

One question, I may have missed. Is he out on his own recognizance or is he out on bail? If bail, that presents another interesting question.. yes indeed...

I saw that.. I said something out of Genesis, and what Solomon said, about evil deeds of men. And it got deleted because I am not actually the person Solomon, or perhaps because I read what the Lord said in Genesis about every thought of man being only evil continually... Someone here, a mod, deleted that because they didn't like it. It hit them personally... Happens all the time.. But I don't know why... Off-topic posts may get deleted. That's why.

Also, not be antagonistic, and I do understand that it might be said that Ronhall, sherbear, and myself were off topic, scrolling back I see people about "God taking care of everything", or about relationships between lawyers and clients, so in discussing child sexual assault, policemen, and the like, I personally feel we were on topic as much as anyone. After all I asked several questions about the case... You almost had me thinking that it was all my fault again.. But I am more of a target of scrutiny I suppose... Prolly why I get panic attacks... who knows? but it was right after I saw my posts deleted that I had one...

Some people have got much too much spare time. Do you mean the perp? we hear he's building his house. Who says crime doesn't pay? But perhaps they're giving time for some of the other victims to have a change of heart.

left the group over 3 decades ago. EB was displaying this sort of behaviour then. the issue is common to groups all over the world - religous and otherwise. this sort of behaviour is fostered by poorly trained people in power and lack of accoutability, epitomised by power structures where speaking out is censored. These are atributes common to the truth. I can state it for a fact but everyone knows it in their 'heart', the problems with EB were known well before DL came to any sort of power. DL and any other worker are simply the tip of an iceberg - it is the base that directs the tip all professing people need to make their family, their elders, the workers know this behaviour is unacceptable. blaming DL for not dealing with this appropriately achieves nothing, does nothing for the victims. having the guts to speak out gives victims validation and strength.

Puzzled, why didn't you speak out 3 decades ago? What strength has exposing him given any victims apart from one who pressed police charges? do you know any others who feel validated or are getting strength to expose their molester to police to protect future children?
